1. Acceptance of Terms

By accessing or using Momentian ("Service"), available at momentian.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

2. Description of Service

Momentian is a platform that helps people organize and participate in real-life gatherings called "moments." Users can create moments, invite connections, RSVP to events, and engage in interactive activities during those moments.

3. Eligibility

You must be at least 13 years of age to use Momentian. By using our Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Harass, abuse, or harm other users
  • Post content that is hateful, discriminatory, threatening, or pornographic
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to other accounts or systems
  • Use automated systems (bots, scrapers) without permission
  • Interfere with or disrupt the Service or its servers
  • Upload viruses, malware, or other malicious code
  • Spam or send unsolicited communications
  • Collect user information without consent

6. User Content

You retain ownership of content you create ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating the Service.

You are solely responsible for your User Content. You represent that you have all necessary rights to post such content and that it does not violate any third-party rights.

We may remove any User Content that violates these Terms or that we find objectionable, at our sole discretion.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Momentian and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by Momentian. We are not responsible for the content, privacy policies, or practices of any third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for any events, gatherings, or interactions that occur as a result of using our Service. Users participate in moments at their own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMENTIAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Momentian and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. You may also delete your account at any time through the app settings.

Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination will survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Momentian operates, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Momentian regarding your use of the Service and supersede any prior agreements.
